Description

A building code is a set of rules that specify the standards for constructed objects such as buildings and nonbuilding structures. Buildings must conform to the code to obtain planning permission, usually from a local council. The main purpose of building codes is to protect public health, safety and general welfare as they relate to the construction and occupancy of buildings and structures. The building code becomes law of a particular jurisdiction when formally enacted by the appropriate governmental or private authority.

Understanding the Ontario Building Code and the Consumer Protection Act (CPA) can be difficult since the Code is a complex and ever-evolving piece of legislation. Furthermore, failure to recognise the implications of the regulation can impact future and current building practices.

This course is facilitated by a legal professional to ensure that the strength of the participant’s legal knowledge matches that of building practice compliance. The training will also help attendees to develop the skills needed to deal with people who fail to comply with the law during construction.

PROGRAM OBJECTIVES

Upon completion of this course, participants will have a sound understanding about:

  • Building regulation terminology
  • Contractual and legal obligations in relation to time and money under the Ontario Building Code
  • Health & safety implications for the construction and building sector as introduced under the Building Code 2012
  • International legislation relating to matters such ‘time at large’, acceleration, termination, extensions of time and damages for delay
  • Legal implications of unilateral suspension of work in progress or termination of a contract
  • Legal implications of unilateral termination of a contract
  • Regulations regarding extensions of time and valuation of variations
  • The contractual duties of engineers and contractors regarding what they can and cannot do
  • The significance of new legislation included in the Ontario Reg. 332/12: BUILDING CODE

LEARNING OUTCOMES:

By the end of this course, participants should be able to:

  • Avoid common contractual pitfalls
  • Avoid costly disputes while maintaining good working relationships
  • Determine when to seek professional legal help
  • Determine when to suspend work in progress or terminate a contract
  • Lawfully challenge the engineer or the contractor or the employer’s representative on decisions regarding extensions of time and valuation of variations
  • Understand the importance of being in compliance with the law during construction
